I. GENERAL REGULATIONS

This document defines the principles of operation and use of the Website, the rules of collecting and processing personal data, as well as the rights and obligations related to the use of the Website.

II. TERMS OF USE OF THE WEBSITE

By starting to use the Services, the User accepts these Terms and Conditions and undertakes to comply with their provisions.

The condition for using the Website is meeting the following technical requirements: an internet connection, a device enabling the use of a web browser, a web browser, and in the case of using the Contact Form Service – also having an email account.

All content contained on the Website is for informational purposes only and does not constitute a commercial offer within the meaning of the provisions of the Civil Code.

The Service Provider undertakes to provide Services free of charge electronically to the User consisting of:

• providing information via specific pages of the Website about the car import services from the USA offered by the Service Provider, services provided by him, methods of cooperation with clients, and updates regarding the Service Provider’s business,
• enabling the submission of a request for contact from the Service Provider’s customer service office, representative, or another employee/associate,
• enabling the execution of preliminary calculations of fees related to the purchase of a vehicle at a US auction, customs clearance, and excise duty costs.

The Service Provider reserves the right to temporarily or permanently cease the provision of Services with immediate effect.

The Service Provider is not liable for any damages (including indirect, consequential, or lost profits) arising from or related to:

• the use of the Website,
• cessation of Services,
• making preliminary cost calculations of import,
• the User’s actions contrary to the Terms and Conditions,
• the use of content from links to other websites included in the Website.

The content of the Website is protected by industrial and intellectual property rights. All rights to registered trademarks, graphics, and logos belong to the Service Provider or other entities, and their use by Users without prior consent is prohibited.

It is forbidden for the User to use the Website in a manner contrary to these Terms and Conditions and to provide illegal or offensive content.

The Service Provider emphasizes that using the Website involves typical risks related to using the Internet; therefore, all precautions should be taken to minimize the risk of attacks on the User’s devices by viruses, etc.

No data or software of the Service Provider will be introduced into the User’s IT system, except for cookies intended to correctly display the Website on the User’s device.

The Agreement is terminated once a given Service is performed. The Agreement may also be terminated at any time by either the Service Provider or the User.

Complaints: The User has the right to file complaints regarding the provision of Services in writing to the Service Provider’s address or electronically to: kontakt@apexcars.pl

Complaints will be processed within 14 days of receipt. If this deadline cannot be met, the Service Provider will inform the complainant, stating the reason and the expected processing time.

The Service Provider reserves the right to leave a complaint unprocessed if it results from an obvious lack of knowledge of the Terms and Conditions, contains unlawful content, or is evidently made to disrupt the operation of the Website or Services ("spam").

Amendments: The Service Provider reserves the right to unilaterally amend these Terms and Conditions at any time for important reasons related to the technical or substantive aspects of the Website’s functioning.

All disputes arising under these Terms and the Agreement shall be resolved by the common courts of the Republic of Poland competent for the defendant.

In matters not regulated herein, the applicable provisions of Polish law shall apply.

The Operator is the Controller of your personal data regarding data voluntarily provided on the Website.

The Website processes personal data for the following purposes:

• Conducting online chat conversations
• Handling inquiries via the contact form
• Presenting offers or information about car import services from the USA
• Preparing import cost estimates

The Website collects information about users and their behavior in the following way:

• Through voluntarily entered data in forms, which are entered into the Operator’s systems
• Through the storage of cookies on end devices

2. Information Clause under GDPR

Pursuant to Article 13 of the GDPR, the Administrator informs that:

• Purpose of processing: The User’s personal data will be processed in order for the Controller to contact the User at their request and to provide services related to the import of cars from the USA, based on Article 6(1)(a) GDPR – the User’s consent.
• Recipients of data: Authorized employees and contractors of the Controller, as well as entities entrusted with processing, including IT service providers.
• Transfers to third countries: The Controller will not transfer the User’s data to a third country or international organization unless required in connection with IT services provided by entities based outside the European Economic Area.
• Retention period: The User’s data will be stored until consent is withdrawn or the Service is completed.
• User rights: The User has the right to access their data (Art. 15 GDPR), rectify (Art. 16 GDPR), erase (Art. 17 GDPR), restrict processing (Art. 18 GDPR), data portability (Art. 20 GDPR), and object to processing (Art. 21 GDPR).
• Withdrawal of consent: The User may withdraw consent to processing at any time without affecting the lawfulness of processing carried out before withdrawal.
• Complaint: The User has the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office (PUODO).
• Voluntariness: Providing personal data is voluntary; however, failure to do so will make it impossible for the Controller to process them.

3. Hosting

The Website is hosted (technically maintained) on an external operator’s servers.

The hosting company, to ensure technical reliability, keeps server logs, which may contain:

• resources identified by URL,
• request arrival time,
• response time,
• client station name (via HTTP protocol),
• error information during HTTP transactions,
• referrer URL (previously visited page),
• user’s browser information,
• IP address,
• diagnostic information regarding ordering services via on-site forms,
• information related to email service handling.

4. Information in Forms

The Website collects information voluntarily provided by the User, including personal data if provided.

The Website may record connection parameters (time, IP address).

Data provided in forms are processed for the purpose corresponding to the specific form’s function, e.g., handling service requests or business contact.

5. Administrator Logs

Information about user activity in the Website may be logged. These data are used for Website administration.

The Terms and Privacy Policy come into effect on the date of publication on the Website.
